Constitution of the Jamia - - Dastoor

Section 1: Name of the Institution

The name of this institution shall be “Jamia Dar-ul-Uloom Naseeria Ghorghushti,” and its registered office will be in Ghorghushti.

Section 2: Objectives and Purposes of the Jamia

The objectives and purposes of the Jamia shall be as follows:

  1. Promotion and dissemination of Uloom Deeniya (Quran, Hadith, beliefs, and jurisprudence) among the general Muslim population.
  2. Arranging comprehensive and scholarly education in Quran and Hadith, jurisprudence, and beliefs, taking sufficient account of contemporary needs and requirements, from which experts in Uloom Deeniya with a scholarly perspective can emerge.
  3. Preparing specialists in specific fields along with the general completion of Uloom Deeniya, who can acquire complete expertise in important areas of religion and be capable of providing distinguished services in particular areas (e.g., judiciary, propagation, fatwa, writing, and compilation).
  4. Establishment of a Dar-ul-Ifta to provide facilities for ordinary Muslims to gain awareness of correct religious rulings.
  5. Establishment of a Dar-ul-Tableegh to awaken the religious consciousness of ordinary Muslims and to reform their individual and collective lives in light of proper Islamic rulings.
  6. Establishment of short courses to familiarize educated Muslims who have not acquired Uloom Deeniya with the rulings and requirements of Islam.
  7. Special arrangements for the moral and religious training of all students associated with the Jamia in any way.
  8. Other necessary measures for the dissemination of Islamic teachings and fulfillment of the above-mentioned objectives.

Section 3: Financial Affairs of the Jamia

  1. The financial needs of the Jamia will depend on the attention and support of the general Muslim population.
  2. In this regard, every kind of assistance will be avoided that may weaken the purpose and doctrine of the Jamia.
  3. The Jamia will only adopt those means to fulfill the mentioned objectives that are commendable or permissible according to Islamic law and worthy of a religious institution’s dignity.

Section 4: Officials

The following officials may be in the Majlis Muntazimah, who will also be members of the council:

  1. President
  2. Vice President
  3. Secretary
  4. Treasurer

Duties and Powers of Officials

Section 6: President

The duties and powers of the President shall be as follows:

  1. The President will oversee the objectives and purposes of the Jamia and its doctrine.
  2. The Jamia’s funds, which will be safely held in the bank under the joint name of two selected individuals, will require the President’s signature for withdrawal.
  3. The final approval of the Jamia’s subsidiary regulations will be given by the President.
  4. The President will exercise all administrative powers on behalf of the Majlis Muntazimah, unless any restriction has been imposed by the council.
  5. Without affecting the generality of clause (4), the President shall have the following specific powers:
    • The President will be fully authorized and responsible for all educational departments of the Jamia.
    • The President will have the authority to appoint and remove teachers and staff of the Jamia, promote and demote them, and organize their work.
    • All donations to the Jamia, whether in cash, goods, or in the form of property (both movable and immovable), will be received for the Jamia with the President’s signature. Similarly, the President will have the authority to handle all internal and external administrative matters of the Jamia, dealing with KMC, KDA, criminal and civil courts, high court, supreme court, revenue department, income tax, and any other government or non-government offices either personally or through an advocate, and sign on behalf of the Jamia for all its properties and tax matters, whether endowed or not. If at any time it becomes necessary to sell the Jamia’s endowed or non-endowed property within the bounds of Shariah and with the Majlis Muntazimah’s permission, the President will be authorized to carry out all procedures for selling that property and receiving the full price for the Jamia. Likewise, the President will have the authority to purchase any property in the interest of the Jamia with the approval of the Majlis Muntazimah and to execute all related transactions, paying the price from the Jamia’s treasury.
  6. The President shall have the authority to delegate any of his powers to an individual or a sub-committee.

Section 6 (a): Vice President

The duties and powers of the Vice President shall be as follows:

  1. The Vice President will be responsible for the scholarly, editorial, and research affairs of the Jamia, unless the Majlis Muntazimah modifies or changes these duties and powers.
  2. In the absence of the President, the Vice President will assume his powers.

Section 6 (b): Secretary of the Majlis Muntazimah

The duties of the Secretary of the Majlis Muntazimah shall be as follows:

    1. At the President’s direction, convene meetings of the Majlis Muntazimah and arrange for them.
    2. Compile the proceedings of the Majlis Muntazimah.

Section 6 (c): Treasurer

  1. The Treasurer will maintain the Jamia’s accounts according to the methods prescribed by the council or the instructions of the President.
  2. The institution’s secured funds will be kept in a bank approved by the council.

Section 7: Powers of the Majlis Muntazimah

  1. All powers regarding the institution’s funds, properties, administration, and management shall be vested in the Majlis Muntazimah of the Jamia.
  2. The Majlis Muntazimah may delegate any part of its powers to any official or member of any sub-committee.
  3. The Majlis Muntazimah shall have the authority to fill any vacancy due to resignation, removal, or death of a member.
  4. If any member’s behavior, God forbid, is clearly detrimental to the Jamia and no remedy remains, the Majlis Muntazimah may expel them from membership by a two-thirds majority.
  5. The Majlis Muntazimah shall have the authority to amend the Jamia’s constitution by a two-thirds majority, but shall not have the right to amend the objectives and purposes.
  6. The Majlis Muntazimah shall have the right to formulate subsidiary rules and regulations to conduct the Jamia properly.
  7. The quorum for the meetings of the Majlis Muntazimah shall be five members or one-third of the total members (whichever is greater).

Section 8: Jamia Funds

  1. The Jamia’s total funds shall be deposited in a scheduled bank selected for this purpose by the Majlis Muntazimah, with a clear directive that no interest shall be applied to this amount.
  2. An account will be opened in the bank in the joint name of two selected individuals from the Jamia.
  3. The Majlis Muntazimah shall have the right to formulate subsidiary rules and regulations to conduct the Jamia properly.
  4. For withdrawing funds from the bank, the signatures of the President and the two selected individuals will be necessary.
  5. The Jamia’s accounts will be prepared annually from the 16th of Sha’ban to the 15th of Sha’ban (according to the lunar calendar) and will be audited each year by an approved chartered accountant whose approval has been granted by the Majlis Muntazimah.
  6. All of the Jamia’s funds, properties, and income shall solely belong to the Jamia and will be spent in the interest of the Jamia, and no part of it shall be transferred as profit or bonus to any member of the Majlis Muntazimah or any relative.

Section 9: Doctrine of the Jamia

The doctrine of the Jamia shall be as follows:

    1. The Jamia’s doctrine shall be in accordance with the beliefs of Ahl al-Sunnah wa al-Jama’ah and the Hanafi jurisprudence, and its approach, that is, the method of thought and action, shall align with the teachings of Hujjat al-Islam Hazrat Maulana Muhammad Qasim Nanotwi (may Allah have mercy on him), Imam Rabbani Hazrat Maulana Rashid Ahmad Gangohi (may Allah have mercy on him), and Shaykh Al-Hadith and Tafseer Shaykh Al-Hadith Hazrat Maulana Naseeruddin of Ghorghushti (RA) (may Allah have mercy on him).
    2. In the selection of members of the Jamia and the appointment of teachers and staff, care will be taken to ensure that the Jamia’s approach and doctrine remain unscathed.
    3. The protection of the Jamia’s doctrine will be the duty of all scholars, members, and associates of the Jamia, with special responsibility resting on the President of the Jamia.
